Orlando Bloom and Miranda Kerr - proof there is such a thing as amicable separation.

It is often assumed that all separations and divorces are bitter long winded battles that end with former “madly in love” couples never wishing to see or hear from their ex for the rest of their lives.

However as a family solicitor that deals with the breakdown of relationships and marriages on a daily basis, I can honestly say that a decent number of separations are amicable and can be dealt with on a relatively quick and easy basis.

Not all divorces have to be acrimonious and indeed the most amicable fact to issue a divorce petition on would be based on either 2 years separation with consent or 5 years separation. That way no one is blamed for the breakdown in the marriage and there is a sense of equality.

However if separating couples do not wish to wait that long, I have often advised that unreasonable behaviour can be a fact to rely on and whilst there should be an element of blame on one party, I would encourage both parties drafting the examples of unreasonable behaviour together so that everyone is content with the contents before it is sent to court.
